Terms & Conditions

These Terms & Conditions ("Agreement") govern all services provided by Policy Trace AI ("Policy Trace," "we," or "us"), a Wyoming business entity, to licensed plaintiff attorneys ("Client"). By submitting a case to Policy Trace, the Client acknowledges and agrees to these Terms. Policy Trace reserves the right to modify this Agreement at any time, with revisions effective upon posting or delivery to the Client; continued use of Policy Trace's services after revision constitutes acceptance of the revised Terms.

Nature of Services

Policy Trace, together with its contractors, agents, affiliates, and third-party providers, provides data analysis, due diligence, and predictive research services exclusively to licensed plaintiff injury attorneys, or to the authorized agents of those attorneys, representing accident victims in connection with or in anticipation of litigation. The work coordinated through Policy Trace is limited to producing a policy limit probability assessment and, where applicable, related information, together with supporting data that may support these conclusions. Neither Policy Trace nor its contractors, agents, or third-party providers provide legal advice, settlement evaluation, or case strategy, and nothing furnished through Policy Trace should be construed as such. The Client expressly authorizes Policy Trace to engage and rely upon contractors, agents, affiliated entities, and other third-party providers in its sole discretion for any aspect of the services, including data sourcing, research, analysis, and fulfillment.

Purpose of Services

The services coordinated through Policy Trace are provided for informational purposes only. Our mission is to predict, and where possible verify, the liability policy limits of a defendant or business entity. The purpose of this informational output is to help combat the documented rise in nondisclosure, concealment, or misrepresentation of liability policy limits. Policy Trace and its contractors, agents, and third-party providers perform these services in good faith, for lawful purposes, and at the direction of an engaging attorney.

Attorney Engagement 

Policy Trace accepts engagements only from licensed plaintiff attorneys or their authorized agents. Submission of a case to Policy Trace, together with acknowledgment of these Terms, constitutes the attorney's engagement and direction. By submitting a case, the attorney represents and certifies that the submission accurately identifies the matter, including all relevant parties and the relevant case number; that the submission identifies the jurisdiction or jurisdictions in which the firm is located and in which the matter arises; that the attorney has determined the requested research is necessary for case assessment, and that the engagement complies with all applicable professional, ethical, and legal obligations, including any applicable rules of professional conduct, state bar requirements, and licensing laws of the jurisdictions involved. The attorney further represents that the information submitted to Policy Trace is true and accurate to the best of the attorney's knowledge, that the attorney has the authority to engage Policy Trace on behalf of the represented client, and that no part of the engagement is intended for harassment, intimidation, stalking, or any unlawful purpose.

Jurisdiction of Engagement

All engagements are entered into with Policy Trace as a Wyoming entity. Policy Trace operates from Wyoming, and engagement constitutes a contractual relationship with a Wyoming business, Clients nationwide acknowledge that they are engaging directly with a Wyoming company and that Wyoming law governs all engagements regardless of the Client's location or the location of the underlying matter.

Not a Consumer Reporting Agency

Policy Trace is not a consumer reporting agency. Neither Policy Trace nor its contractors, agents, or third-party providers acting in connection with these services assemble, evaluate, or furnish consumer reports, and they do not provide information to determine creditworthiness or eligibility for credit, insurance, employment, housing, or any other purpose governed by the Fair Credit Reporting Act. Information delivered through Policy Trace may not be used for any FCRA-regulated purpose, and the Client agrees not to use any output from Policy Trace for any such purpose.

Informational Use Only

All information delivered through Policy Trace, whether produced directly by Policy Trace or by its contractors, agents, affiliates, or third-party providers, is strictly for informational and analytical purposes. Information is delivered "as is," without warranties of any kind, express or implied, including without limitation any warranties of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose. Outputs are not admissible and may not be relied upon as proof of coverage. Attorneys must independently verify insurance coverage information before any reliance or use in litigation. Policy Trace does not guarantee, warrant, or represent that any results, findings, or information provided are complete, accurate, or free from error, and the Client acknowledges that errors, omissions, and inaccuracies may occur. All materials, analyses, and outputs are for informational and research purposes only and are not intended to create reliance of any kind. Policy Trace expressly disclaims any responsibility or liability for how the information is used or interpreted in any legal, professional, or strategic context, and disclaims the same on behalf of its contractors, agents, and third-party providers to the fullest extent permitted by law. All results must be independently reviewed, confirmed, and verified by the Client's attorney or other appropriate professional within the scope of their case or matter, entirely outside of Policy Trace, and the Client remains solely responsible for ensuring the accuracy, applicability, and legal sufficiency of the information before relying on it in any capacity.

Fees, Payment, and Refunds

Fees for the services coordinated through Policy Trace are due as quoted or invoiced at the time of engagement and are payable in accordance with the terms specified on the applicable invoice or order form. . The Client understands that fees compensate the analytical effort, coordination, and methodology, not any guaranteed accuracy. 

Confidentiality

All information provided to Policy Trace in the course of an engagement is treated as confidential and/or attorney work product, and is used solely to perform the agreed services. Policy Trace may share Client information with its contractors, agents, affiliates, and third-party providers as necessary to complete the engagement, each of whom is subject to confidentiality obligations consistent with this Agreement. Policy Trace does not otherwise disclose attorney or Client information except with the Client's authorization or as required by law, subpoena, or court order. These confidentiality obligations survive termination of any engagement.

Ownership and Use of Outputs

Outputs and deliverables prepared by or through Policy Trace are licensed to the Client for use in the specific matter for which they were commissioned. The Client may not republish, resell, redistribute, or use these outputs for any matter other than the one identified in the engagement without Policy Trace's prior written consent. Policy Trace and its contractors, agents, and third-party providers retain all rights in their respective proprietary methodologies, models, data sources, templates, and underlying research processes.

Limitation of Liability

To the fullest extent permitted by law, neither Policy Trace nor its contractors, agents, affiliates, or third-party providers shall be liable for errors, omissions, or misstatements made by any third party or data source; for delays, refusals, or failures outside their reasonable control; for reliance placed on any output without independent attorney confirmation; or for any damages, whether direct, indirect, incidental, consequential, special, exemplary, or punitive, arising from or relating to the use of services coordinated through Policy Trace. In no event shall Policy Trace's aggregate liability, together with that of its contractors, agents, affiliates, and third-party providers, arising out of or relating to this Agreement or the services provided, exceed the total fees actually paid by the Client to Policy Trace for the specific engagement giving rise to the claim. Attorneys accept full responsibility for evaluating, verifying, and relying upon any information reported through Policy Trace.

No Guarantee of Outcome

Engagement with Policy Trace does not guarantee that liability policy limit information will be obtained, that any information obtained will be accurate, or that any particular case outcome will follow. The Client acknowledges that predictive and analytical work is inherently uncertain and that public and quasi-public records may be incomplete, outdated, or erroneous through no fault of Policy Trace or its contractors, agents, or third-party providers.

Indemnification

The Client agrees to indemnify, defend, and hold harmless Policy Trace AI and its owners, members, employees, contractors, agents, affiliates, and third-party providers from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to the Client's use or misuse of any information delivered through Policy Trace; the Client's breach of this Agreement or any representation made under it; the Client's violation of any applicable law, rule of professional conduct, or third-party right; or any decisions made or actions taken in reliance on any output. The outputs delivered through Policy Trace are for informational purposes only and are not intended to constitute legal advice; Clients must independently verify policy limits, as these outputs do not constitute confirmed insurance coverage. The Client assumes full responsibility for how it uses any information provided and agrees that Policy Trace and its contractors, agents, and third-party providers shall have no liability for decisions made or actions taken in reliance on such information.

Term and Termination

This Agreement governs each engagement upon submission of a case and continues in effect with respect to that engagement until the requested services are completed or the engagement is terminated. Either party may terminate an engagement at any time upon written notice. Termination does not relieve the Client of the obligation to pay for services performed prior to termination, and the provisions of this Agreement that by their nature should survive termination, including those relating to confidentiality, ownership, limitation of liability, indemnification, and governing law, shall survive.

Force Majeure

Neither Policy Trace nor its contractors, agents, or third-party providers shall be liable for any failure or delay in performance caused by circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, governmental action, civil unrest, labor disputes, public health emergencies, internet or utility outages, third-party data source failures, or other events of force majeure.

Entire Agreement and Modification

This Agreement constitutes the entire agreement between Policy Trace and the Client with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, representations, or agreements, whether written or oral. No modification, waiver, or amendment of this Agreement shall be effective unless made in writing by Policy Trace. The failure of Policy Trace to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Assignment

The Client may not assign or transfer this Agreement, or any rights or obligations under it, without Policy Trace's prior written consent. Policy Trace may assign this Agreement in connection with a merger, acquisition, reorganization, or sale of substantially all of its assets.

Severability

If any provision of this Agreement is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be reformed to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

Governing Law and Venue

This Agreement shall be governed by and construed under the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in Wyoming, and each party irrevocably consents to the personal jurisdiction and venue of those courts and waives any objection based on inconvenient forum.

Acknowledgment

By submitting a case to Policy Trace or otherwise engaging Policy Trace's services, the Client acknowledges that it has read, understood, and agreed to these terms.
